By using TechYXE's services, you agree to these Terms of Service. Please read them carefully before engaging our technology services in Saskatoon, Saskatchewan.

1. Acceptance of Terms

By accessing our website or using our services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our services.

2. Services Provided

TechYXE provides the following technology services in Saskatoon, Saskatchewan:

  • Website and mobile app development
  • Computer repair and technical support
  • Windows OS installation and optimization
  • Data recovery services
  • Other technology consulting services as agreed upon

3. Service Agreements

3.1 Quotes and Estimates

All quotes and estimates are valid for 30 days unless otherwise specified. Final pricing may vary based on the scope of work discovered during service delivery. We will notify you of any significant price changes before proceeding.

3.2 Payment Terms

  • Payment is due upon completion of services unless otherwise agreed
  • For website development projects, a 50% deposit may be required to begin work
  • Data recovery services follow a "no recovery, no charge" policy
  • Late payments may be subject to a 2% monthly interest charge
  • Accepted payment methods: Cash, e-transfer, credit card, or as agreed

3.3 Cancellation Policy

You may cancel services with 24 hours notice for a full refund of any deposit. Cancellations with less notice may be subject to a cancellation fee. Work already completed will be billed at our standard rates.

4. Client Responsibilities

As a client, you agree to:

  • Provide accurate and complete information for service delivery
  • Back up your data before service work begins (we are not responsible for data loss)
  • Provide necessary access to systems, accounts, or equipment
  • Review and approve work in a timely manner
  • Pay invoices on time according to agreed payment terms
  • Comply with all applicable laws when using our services

5. Warranties and Guarantees

5.1 Service Warranty

We guarantee our work for 30 days from the date of service completion. If issues arise from our work within this period, we will correct them at no additional charge. This warranty does not cover new issues, user error, or damage caused by third parties.

5.2 Website Development

Websites are guaranteed to function as specified in the project agreement. We provide a 30-day bug fix period after launch. Ongoing maintenance and updates are available through separate service agreements.

5.3 Data Recovery

Data recovery services follow a "no recovery, no charge" policy. While we make every effort to recover your data, we cannot guarantee success in all cases. We are not liable for data that cannot be recovered.

6. Limitation of Liability

TechYXE's liability for any claim related to our services is limited to the amount you paid for those specific services. We are not liable for indirect, incidental, or consequential damages, including but not limited to lost profits, data loss, or business interruption.

7. Data and Privacy

We take data privacy seriously:

  • We maintain confidentiality of all client information and data
  • Client data is not shared with third parties except as required by law
  • Data on devices serviced may be accessed for troubleshooting purposes only
  • We strongly recommend backing up all data before service

8. Intellectual Property

8.1 Client Ownership

Upon full payment, you own the final deliverables of website development projects, including custom code and design elements created specifically for your project. You receive a license to use any third-party components included in the work.

8.2 TechYXE Rights

We retain the right to showcase completed projects in our portfolio and marketing materials unless otherwise agreed. We also retain ownership of our proprietary tools, frameworks, and methodologies used in service delivery.

9. Third-Party Services

We may recommend or integrate third-party services (hosting, domains, software licenses, etc.). You are responsible for the costs and terms of these third-party services. We are not liable for third-party service failures or policy changes.

10. Service Modifications

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time. We will provide reasonable notice of significant changes. Ongoing service agreements will be honored or refunded on a pro-rata basis.

11. Dispute Resolution

Any disputes arising from these terms or our services will be resolved through good faith negotiation. If negotiation fails, disputes will be subject to the laws of Saskatchewan, Canada, and the jurisdiction of courts in Saskatoon.

12. Indemnification

You agree to indemnify and hold TechYXE harmless from any claims, damages, or expenses arising from your use of our services, your violation of these terms, or your violation of any rights of another party.

13. Force Majeure

We are not liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including but not limited to natural disasters, power outages, internet failures, or other acts of God.

14. Severability

If any provision of these Terms of Service is found to be unenforceable, the remaining provisions will remain in full effect, and the unenforceable provision will be replaced with an enforceable provision that best reflects the original intent.

15. Changes to Terms

We may update these Terms of Service from time to time. Significant changes will be communicated via email or prominent notice on our website. Continued use of our services after changes constitutes acceptance of the updated terms.
